A recent enquiry involved a married couple living in Malaysia under the Malaysia My Second Home programme. As part of their MM2H pass renewal, they were asked to provide a certified and legalised copy of their UK marriage certificate.

The couple obtained a newly issued UK marriage certificate and arranged an apostille through the UK Foreign, Commonwealth & Development Office. However, when the document was presented in Malaysia, it was not accepted. The receiving party required one further step: legalisation by the High Commission of Malaysia in London.

This is an important distinction. An FCDO apostille and Malaysian High Commission legalisation are separate stages. Depending on the instructions issued by the Malaysian authority, immigration adviser or MM2H agent handling the application, an FCDO apostille may not be the final step.

For an England and Wales marriage or birth certificate, the required document chain may therefore be:

Official GRO certificate → FCDO paper apostille → Malaysian High Commission legalisation → international delivery to Malaysia

The precise requirements should always be checked against the written instructions issued for the individual MM2H renewal or Malaysian administrative application.

Is It an Apostille from the Malaysian High Commission?

The terminology is often confused.

The UK apostille is issued by the FCDO Legalisation Office. The FCDO checks the signature, seal or stamp appearing on the UK document and attaches an official apostille certificate. Birth and marriage certificates issued by a public registry are among the UK documents that can be legalised directly by the FCDO.

The subsequent Malaysian stage is normally described as:

  • Malaysian High Commission legalisation;
  • Malaysian consular legalisation;
  • High Commission attestation; or
  • Malaysian embassy authentication.

It should not technically be described as a second apostille. The High Commission of Malaysia in London lists legalisation of foreign documents as one of its consular services.

The more accurate wording is therefore:

FCDO apostille followed by Malaysian High Commission legalisation.

Why Might an Apostilled Marriage Certificate Be Rejected?

An FCDO apostille confirms the UK authentication stage, but the organisation receiving the document in Malaysia may require a complete consular legalisation chain.

This may arise in connection with:

  • MM2H pass renewals;
  • applications involving a spouse or dependant;
  • Malaysian immigration applications;
  • proof of marriage or family relationship;
  • registration of an overseas marriage;
  • property or banking matters;
  • inheritance and probate;
  • citizenship or nationality applications; or
  • another Malaysian administrative procedure.

In the recent case, the marriage certificate already carried the FCDO apostille. The remaining requirement was the additional legalisation stamp from the Malaysian High Commission in London.

This does not mean that every MM2H renewal automatically requires High Commission legalisation. It means that applicants should follow the precise wording provided by their MM2H agent, immigration authority or other receiving organisation. Where the instruction refers to the Malaysian High Commission, embassy authentication or consular attestation, the apostille alone may not be sufficient.

Step 1: Obtain the Correct GRO Marriage or Birth Certificate

Where the marriage or birth was registered in England or Wales, an official replacement certificate can normally be obtained from the General Register Office or the relevant local register office.

The GRO issues official copies of:

  • birth certificates;
  • marriage certificates;
  • civil partnership certificates;
  • death certificates; and
  • adoption certificates.

The GRO also provides a priority service where a certificate is needed urgently. Under the current published arrangements, a priority certificate is sent on the next working day when the order is placed before 4:00 pm. Different procedures apply to certificates issued in Scotland and Northern Ireland.

Is a GRO Certificate the Same as a Photocopy?

No.

An official certificate issued by the GRO or a local register office is not the same as an ordinary photocopy of a certificate held at home.

For international use, the receiving organisation may request:

  1. an official certificate issued by the GRO or register office;
  2. a solicitor-certified or notarised photocopy; or
  3. an official certificate carrying an FCDO apostille and consular legalisation.

These requirements are not interchangeable.

Where possible, using an official replacement GRO certificate is often the cleaner route, particularly when:

  • the only existing certificate is old or fragile;
  • the applicant does not wish to send away the family’s only certificate;
  • the receiving authority wants a recently issued certificate;
  • the document must pass through several legalisation stages; or
  • the applicant is managing the process from Malaysia.

Step 2: Obtain an FCDO Paper Apostille

An official GRO marriage or birth certificate can generally be submitted directly for FCDO legalisation because it is a document issued by a public registry.

An additional solicitor or notarial certification is not ordinarily needed simply to apostille an official GRO certificate. However, the position may be different where the applicant wants to use a photocopy rather than the official certificate.

The FCDO currently provides both paper apostilles and e-Apostilles, but GRO marriage and birth certificates are specifically excluded from the e-Apostille service. They require a paper-based apostille.

  • time required to obtain a replacement GRO certificate;
  • Malaysian High Commission processing;
  • additional verification requested by an authority; or
  • DHL delivery between the United Kingdom and Malaysia.

Clients should therefore contact us as early as possible where an MM2H pass or Malaysian immigration deadline is approaching.

Step 3: Malaysian High Commission Legalisation in London

Once the FCDO paper apostille has been attached, the document can be prepared for submission to the High Commission of Malaysia in London where Malaysian consular legalisation is required.

The High Commission’s current guidance distinguishes between original documents and copies. It states in relevant consular guidance that a copy of a non-Malaysian document must be notarised by a UK Notary Public and subsequently legalised by the UK FCDO.

This makes it especially important to establish at the beginning whether the Malaysian recipient wants:

  • the official GRO certificate;
  • a notarised copy;
  • the certificate with an FCDO apostille only;
  • the certificate with both an FCDO apostille and Malaysian High Commission legalisation; or
  • additional passport, identity or relationship documents.

The High Commission may also require an application form, copies of identity documents or other supporting material depending on the purpose of legalisation.

Consular requirements, payment arrangements, fees and processing times can change. Final acceptance remains subject to the High Commission and the authority receiving the document in Malaysia.

Step 4: Scanned Copy and DHL Delivery to Malaysia

After the Malaysian High Commission legalisation has been completed, Ginkgo Advisory can:

  • provide a scanned copy by email;
  • package the original securely;
  • arrange tracked DHL Express delivery; and
  • send the document to the client, MM2H agent, lawyer or nominated recipient in Malaysia.

Delivery can be arranged throughout Malaysia, including Kuala Lumpur, Putrajaya, Selangor, Port Klang, Penang, Johor Bahru, Malacca, Ipoh, Kota Kinabalu and Kuching.

Applicants living in Malaysia therefore do not need to travel to London to complete the UK legalisation stages.

Do UK Marriage Certificates Need Notarisation Before Apostille?

An official marriage certificate issued by the GRO or a local register office can generally be apostilled directly as a public-registry document. The FCDO expressly recognises birth, marriage and death certificates as documents capable of direct legalisation.

A plain photocopy is different. Where the receiving party specifically asks for a notarised copy, the copy may need to be certified by a UK Notary Public before it can receive the FCDO apostille and any subsequent Malaysian legalisation.

Applicants should not arrange notarisation automatically without first confirming which form of document is required. Unnecessary notarisation can add cost and may still produce the wrong document for the Malaysian application.

Can a UK Birth Certificate Be Handled in the Same Way?

Yes. The same managed service can be provided for an England and Wales birth certificate.

A UK birth certificate may be required in Malaysia for:

  • an MM2H dependant;
  • proof of parentage;
  • child registration;
  • citizenship or nationality matters;
  • school admission;
  • inheritance;
  • immigration; or
  • another family-related application.

The usual route, where full Malaysian consular legalisation is requested, is:

Official GRO birth certificate → FCDO paper apostille → Malaysian High Commission legalisation

As with marriage certificates, a GRO birth certificate cannot currently receive an e-Apostille and must use the paper apostille route.

Common Mistakes That Cause Rejection or Delay

Calling the High Commission stamp an apostille

The UK apostille is issued by the FCDO. The Malaysian High Commission provides the subsequent Malaysian consular legalisation.

Assuming the FCDO apostille is always the final step

Some Malaysian recipients accept an apostille alone, while others specifically require High Commission legalisation. The written instructions must be checked.

Submitting an ordinary photocopy

A plain photocopy may not satisfy either the FCDO or Malaysian High Commission requirements.

Applying for an e-Apostille

GRO birth and marriage certificates are not eligible for the UK e-Apostille service.

Ordering the wrong marriage entry

Similar names, previous surnames and incomplete registration details can result in the wrong certificate being ordered. The marriage details of both spouses should be cross-checked carefully.

Failing to account for the whole timetable

The total timetable may include GRO certificate issuance, delivery to London, FCDO apostille processing, Malaysian High Commission processing and international courier transit.

Ignoring name differences

A difference between the name on the certificate, passport and MM2H record may trigger requests for additional evidence.
