AEMPS certificates for Nigeria: medical-device and in vitro diagnostic (IVD) export documents, free-sale evidence and Spanish-origin authentication.
For an AEMPS certificate requested in Nigeria, a Spanish apostille should not be assumed to replace required embassy or consular legalisation. Nigeria is not listed as a Convention contracting party at the research date. Confirm whether authentication is needed, then assess the Spanish-origin diplomatic chain and the certificate’s substantive suitability.

Nigeria: check the country of manufacture before authenticating an AEMPS certificate
NAFDAC’s medical-device registration guidance asks for a free-sale certificate from the relevant health or regulatory body in the country of manufacture, identifying the manufacturer and products. It also describes authentication by the Nigerian embassy or high commission in the country of origin. These are more specific requirements than simply holding any European export certificate.
An AEMPS certificate issued in Spain must therefore be reviewed against the actual manufacturing location and the Nigerian application. A Spanish authorised representative does not, by itself, establish that the device was manufactured in Spain. Obtain written confirmation of acceptability where the manufacturer is in another country.
Keep the local representative’s authority, manufacturer details and product schedule aligned. A power of attorney or representation agreement is a separate document: its issuer, signature and authentication route need their own review. Legalising a suitable certificate does not complete NAFDAC product registration or import clearance.
Official starting point: National Agency for Food and Drug Administration and Control (NAFDAC). Obtain the current checklist for the actual product and filing.

Check the certificate before paying for authentication
AEMPS means Agencia Española de Medicamentos y Productos Sanitarios. CLV and CEX references do not make every document interchangeable: read whether the certificate establishes free sale, export status or another specific matter. A pharmaceutical product certificate, GMP document or another AEMPS product category needs its own review.
- Destination: check that the certificate names Nigeria; CERTPS certificates are issued for named countries.
- Identity and scope: compare the legal manufacturer, sites, representative and products. Individual model codes are not universally mandatory in AEMPS certificates; establish coverage through the actual named products, families or ranges and the recipient’s requirements.
- Integrity: retain the original signed PDF, complete annex and verification code. Do not edit, crop or reconstruct the public certificate.
Use the AEMPS electronic-certificate verification service where applicable, together with the AEMPS CERTPS FAQs: destination, originals and certificate recency.
Apostille or embassy legalisation for Nigeria: the Spanish route
First obtain the recipient’s written authentication request. Absence from the Apostille Convention does not mean that every recipient automatically needs a legalised certificate. Where formal legalisation is required and no exemption applies, the Spanish document’s signature and format determine the steps.
- For the electronically signed AEMPS documents described in Spanish guidance, arrange prior signature recognition through Spain’s Ministry of Health.
- Complete the applicable legalisation by Spain’s Ministry of Foreign Affairs, European Union and Cooperation.
- Confirm legalisation by the competent diplomatic representation of the destination country and any separately requested in-country step.
Handwritten originals and private supporting documents can follow different preparation requirements. Confirm the competent mission and its accepted format before dispatch; a UK embassy workflow is not automatically the correct route for a Spanish public certificate.

Practical example: an AEMPS file for Nigeria
Illustrative scenario, not a reported client case. A Spanish company supplies a certificate covering products made at a third-country factory. Before arranging Nigerian consular authentication, ask whether NAFDAC will accept that Spanish certificate or instead needs a certificate from the manufacturing country. Authentication cannot repair the wrong evidential origin.
Translations and document format for Nigeria
Language to confirm with the recipient: English. This is a preparation prompt, not a claim that translation is mandatory for every submission. Agree whether the certificate, annex and authentication wording need translation, and what certification is accepted. Keep translations separate from the unchanged electronic original.
Solicitor-led AEMPS document support for Nigeria
Ginkgo Advisory offers solicitor-led document review and coordination: checking AEMPS verification information, identifying existing authentication, reviewing destination and annex consistency, and arranging an appropriate Spanish apostille or diplomatic legalisation route through the relevant channels where needed. Any copy certification, notarisation or translation is assessed on its own purpose and acceptance requirements.
Send the original PDF, full annex, any apostille, the recipient’s written checklist, manufacturing-country details and deadline. Fees and timing depend on the work actually needed. No standard two-working-day UK FCDO promise is applied to Spanish AEMPS or consular work. Document authentication does not guarantee regulatory approval or import clearance.

AEMPS certificates for Nigeria: frequently asked questions
Is every AEMPS free-sale certificate suitable for a Nigerian medical-device registration?
No. NAFDAC’s guidance refers to the country of manufacture and specified manufacturer and product information. AEMPS issuance in Spain is not proof that Spain is the manufacturing country. Check the exact certificate against the Nigerian dossier before spending on legalisation.
Can an AEMPS certificate issued for another country be reused in Nigeria?
Do not assume so. AEMPS’s CERTPS guidance describes certificates issued for named destination countries, with a certificate and fee for each destination. Check whether the document is issued for Nigeria; a different destination may require a new issue rather than a new stamp on the old certificate.
How recent must the AEMPS certificate be for Nigeria?
AEMPS explains that its export certificates reflect the position on their issue date and have no universal expiry date. The recipient decides how recent the evidence must be. A new apostille does not change the certificate’s original issue date.
Does the certificate need a UK solicitor certification or UK FCDO apostille for Nigeria?
Not as a substitute for the original Spanish public-document route. UK solicitor certification can concern a separate copy, translation or supporting document where appropriate and accepted. A UK apostille on that certification authenticates the UK signature, not the original AEMPS signature.
Sources and scope
This destination guide uses AEMPS export and free-sale certificate guidance, Spanish authentication guidance and the HCCH treaty record linked above. Local authority links identify official starting points; where a detailed local rule is not stated, obtain the current product-specific checklist. The illustrative scenario is preparation guidance, not evidence of a local legal requirement.
Scope: medical-device and IVD certificates issued in Spain. This is not a guarantee of market access, a complete product-registration opinion or a statement that every export requires legalisation. Requirements and service availability must be confirmed for the actual document and transaction.
