Need to use a UK divorce document in Italy?
You may need more than a printed court PDF.
If your previous marriage ended in England or Wales, an Italian authority may ask for an apostilled Decree Absolute or Final Order before it accepts that you are divorced.
This often applies when you need the document for:
- remarriage in Italy;
- a filing with the Comune;
- an update at the ufficio dello stato civile;
- an Italian notary;
- property sale or transfer in Italy;
- succession or inheritance;
- Italian court proceedings;
- passport, citizenship, residence or consular matters.

1. The Key Issue: Italy Needs a Clear Document Trail
A UK divorce document may be legally valid in England and Wales.
But for Italy, the document must also be easy for the Italian authority to understand and accept.
A stronger route usually looks like this:
UK court document → solicitor review → solicitor certification → FCDO apostille → Italian translation if required → use in Italy
This route works better than sending a loose scan or uncertified PDF.
It gives the Italian authority a clearer chain from the UK court record to the final apostilled document.
2. Decree Absolute or Final Order?
A Decree Absolute is the older final divorce order in England and Wales. It usually applies to divorces completed before 6 April 2022.
A Final Order is the current final divorce order. It usually applies to divorce cases issued on or after 6 April 2022.
Both documents prove that the marriage or civil partnership has legally ended.
For Italian use, the name matters less than the preparation. The Italian authority usually wants the document to be clear, properly certified, apostilled and translated where required.
3. Common Italy-Use Scenarios
Clients often need a UK Decree Absolute or Final Order for:
- getting married again in Italy;
- proving divorce status to a Comune;
- updating Italian civil status records;
- filing documents with an ufficio dello stato civile;
- dealing with an Italian lawyer or notary;
- buying, selling or transferring Italian property;
- handling Italian succession or inheritance;
- filing documents in an Italian court;
- updating Italian passport, ID, residence or citizenship records.
Each authority may apply its own checklist. A Comune in Rome, Milan, Florence, Bologna, Naples, Palermo, Venice or another Italian town may ask for slightly different supporting documents.
4. Why an Old PDF May Cause Problems
Many clients only have an old scan or downloaded PDF.
That may not be the best version for Italy.
Before apostille, you should check:
- whether the document is a Decree Absolute or Final Order;
- whether the copy came from HMCTS or the court;
- whether it is an electronic PDF, court copy, scan or older paper document;
- whether the names, dates, case number and court details are clear;
- whether the electronic Family Court seal appears properly;
- whether a fresh HMCTS or court copy would create a stronger starting point;
- whether solicitor certification is required before apostille.

5. Stronger Solicitor Certification for Italy
Some providers only certify a document with wording such as:
“I certify this is a true copy of the document presented to me.”
That may be too basic for overseas use.
It may only confirm that someone showed a printout to the solicitor. It may not explain the source, format or link to the UK court-issued document.

6. Electronic UK Divorce Orders
Many modern divorce orders from England and Wales are electronic documents.
They may show an electronic Family Court seal.
That does not make the document invalid.
The issue is presentation.

The wording should match the document.
A PDF should be described as a PDF.
An HMCTS copy should link back to HMCTS.
A scan should not be overstated.
