Need to use a UK divorce document in Spain?

A printed PDF may not be enough.

If your previous marriage ended in England or Wales, a Spanish authority may ask for an apostilled Decree Absolute or Final Order before it accepts that you are legally divorced.

This often matters when you need the document for:

  1. marriage or remarriage in Spain;
  2. a civil marriage file at the Registro Civil;
  3. Spanish immigration or residence matters;
  4. a Spanish notary;
  5. property purchase, sale or transfer;
  6. inheritance or succession;
  7. Spanish court or legal proceedings;
  8. consular, nationality or family record matters.

1. Start with the Right Document Route

A UK divorce order may prove that your marriage legally ended in England and Wales.

For Spain, the document also needs a proper overseas-use route.

A strong route usually looks like this:

UK court document → source review → solicitor certification → FCDO apostille → Spanish sworn translation if required → use in Spain

This route gives the Spanish authority a clearer chain from the UK court record to the final apostilled document.

GOV.UK confirms that the UK Legalisation Office checks the relevant signature, stamp or seal and legalises a document by attaching an apostille.

The Spanish Consulate in London also states that foreign public documents must be legalised or apostilled to be valid in Spain.


2. Decree Absolute or Final Order?

A Decree Absolute is the older final divorce order in England and Wales.

It usually applies to divorces completed before 6 April 2022.

A Final Order is the current final divorce order.

It usually applies to divorce cases issued on or after 6 April 2022.

Both documents prove that a marriage or civil partnership has legally ended.

For Spain, the key question is not only the document name. The Spanish authority will usually want the document to be clear, properly certified, apostilled and translated where required.


3. When You May Need a UK Divorce Document in Spain

Clients often need a UK Decree Absolute or Final Order for:

  1. getting married again in Spain;
  2. proving divorce status to the Registro Civil;
  3. preparing a Spanish civil marriage application;
  4. supporting a residence or visa application;
  5. dealing with a Spanish notario;
  6. buying, selling or transferring property in Spain;
  7. handling inheritance or succession;
  8. filing documents in a Spanish court;
  9. dealing with a Spanish lawyer, bank, consulate or public authority.

The final checklist can vary by municipality, autonomous community, registry office, notary or receiving authority.

A Madrid, Barcelona, Valencia, Málaga, Alicante, Seville, Marbella, Mallorca, Tenerife or Canary Islands authority may ask for slightly different supporting documents.


4. Why an Old PDF May Cause Problems

Many clients only hold an old scan, downloaded court PDF or unclear copy.

That may not be the best version for Spain.

Before apostille, check:

  1. whether the document is a Decree Absolute or Final Order;
  2. whether the copy came from HMCTS or the court;
  3. whether it is an electronic PDF, court copy, scan or older paper document;
  4. whether the names, dates, case number and court details are clear;
  5. whether the electronic Family Court seal appears properly;
  6. whether a fresh HMCTS or court copy would create a stronger starting point;
  7. whether solicitor certification is required before apostille.

5. Stronger Solicitor Certification for Spain

Some providers only certify a copy with wording such as:

“I certify this is a true copy of the document presented to me.”

That wording may be too basic for overseas use.

It may only confirm that someone showed a printout to the solicitor. It may not explain the source, format or link to the UK court-issued document.

That does not make the document invalid.

The issue is presentation.

The wording should match the document.

A PDF should be described as a PDF.
An HMCTS copy should link back to HMCTS.
A scan should not be overstated.

Depending on the receiving authority, you may need:

  1. Spanish sworn translation;
  2. translation by a translator registered in Spain;
  3. apostilled document first, then translation;
  4. original apostilled document;
  5. scanned copies for pre-check;
  6. physical originals for filing.

Always confirm the final requirement with the Spanish authority receiving the document.
