Hong Kong Apostille Service: Competent Authority & Documents

Ginkgo Advisory

Hong Kong Apostille services and document legalisation: A birth certificate, diploma, court paper or company extract from China (Hong Kong Special Administrative Region) may need an Apostille before it can be used internationally. Ginkgo Advisory can help assess the required formalities and, where practical arrangements are available, coordinate processing through the proper designated local authority.

Official Apostille authority for China (Hong Kong Special Administrative Region)

According to the Hague Conference on Private International Law (HCCH), the authority or authorities designated to issue Apostilles for China (Hong Kong Special Administrative Region) include the Registrar, Senior Deputy Registrar and Deputy Registrar of the High Court of Hong Kong. A Competent Authority is the public institution or official authorised under Article 6 of the 1961 Apostille Convention to issue the Apostille certificate. It is not a private document agency, intermediary or UK solicitor.

Local authority arrangements: Hong Kong SAR has an Apostille system separate from Mainland China and Macao SAR. A document issued by a Hong Kong registry, court, company or university must be assessed for the Hong Kong High Court route, not automatically routed to the Mainland China Foreign Affairs Office.

For the current designated-office information and contact routes, consult the HCCH Competent Authority details for Hong Kong. The HCCH official list of Apostille Competent Authorities lists every participating jurisdiction.

Documents that may qualify for a Hong Kong Apostille

Typical enquiries concern the following records issued in China (Hong Kong Special Administrative Region). Whether a particular document is apostillable depends on its legal status, signature, issuing body and the rules of the Competent Authority. Some private documents require notarisation or prior official certification.

  • Civil status and family: birth certificates, marriage certificates, death certificates, civil-status extracts, certificates of no impediment, name-change evidence and adoption papers.
  • Education and professional records: university degree certificates, academic transcripts, diplomas, school certificates, professional qualifications, and official enrolment or award letters.
  • Court, police and legal documents: police or criminal-record certificates, court orders, divorce decrees, probate or inheritance records, affidavits, declarations and powers of attorney.
  • Companies and commercial records: certificates of incorporation, company registry extracts, certificates of good standing, directors’ resolutions, corporate powers of attorney and notarised business documents.
  • Other public or notarised records: government letters, administrative records, authorised copies, and other official or notarial instruments that the relevant authority accepts.

Document acceptance is not automatic. Official originals, certified copies, notarised declarations, university verification or translations may be required. Documents executed abroad do not become public documents from China (Hong Kong Special Administrative Region) merely because the holder currently lives there. The Apostille authenticates the public signature or seal, not the factual content of the document or the underlying qualification.

How to obtain an Apostille for documents from Hong Kong

  1. Check the origin: the country where the public document or authenticated signature was produced.
  2. Check the purpose: immigration, marriage, education, business, court proceedings or another overseas filing.
  3. Confirm whether the document is an original, certified extract or appropriately notarised record.
  4. Match the issuing official to the designated Apostille authority.
  5. Obtain a case-specific quotation and confirm whether local handling is available.
  6. Submit only through the recognised authority and inspect the Apostille before onward use.

An Apostille generally replaces additional embassy legalisation only where the Convention applies between the document’s place of origin and its country of use, and the receiving body accepts the document. Some destinations or document categories may still require other steps. Check the HCCH Apostille Convention status table, including dates of entry into force, extensions and any objections that could affect an individual case.
