Mexico is a popular country for destination weddings, civil marriages and family registration matters.

If you were previously married in the UK, a Mexican Civil Registry Office may ask for proof that your previous marriage has legally ended.

For a previous marriage dissolved in England and Wales, that proof is usually a Decree Absolute or Final Order.

For Mexico, you should usually prepare the document before you travel:

UK divorce document → source review → solicitor certification → FCDO apostille → Spanish translation if required → use in Mexico

Ginkgo Advisory helps clients prepare UK divorce documents for Mexico, including solicitor certification, stronger source-based wording, FCDO apostille and Mexico-ready document presentation.

The Mexican Consulate in the UK states that foreign documents for marriage in Mexico must be apostilled or legalised in their country of origin and translated into Spanish by a registered translator in Mexico. GOV.UK also confirms that the UK Legalisation Office legalises UK documents by attaching an apostille after checking the relevant UK signature, stamp or seal.

1. When You Need a UK Divorce Document for Mexico

You may need an apostilled UK divorce document if:

  1. you are getting married in Mexico after a previous UK marriage;
  2. you are a foreign national previously divorced in England or Wales;
  3. you need a UK Decree Absolute for a Mexican civil marriage;
  4. you need a UK Final Order for a Mexican civil marriage;
  5. a Mexican Civil Registry Office has asked for proof of previous divorce;
  6. your wedding planner in Mexico has asked for an apostilled divorce decree;
  7. you only have an old scan, court PDF or unclear copy;
  8. your UK divorce order has an electronic Family Court seal;
  9. you need solicitor certification before FCDO apostille;
  10. you want the document ready before travelling to Mexico.

Mexican marriage paperwork can vary by state and Civil Registry Office. A marriage office in Mexico City, Cancún, Riviera Maya, Playa del Carmen, Tulum, Los Cabos, Puerto Vallarta, Guadalajara, Monterrey or Oaxaca may apply its own checklist.

2. Decree Absolute or Final Order: What Does Mexico Need?

A Decree Absolute is the older final divorce order in England and Wales.

It usually applies to divorces completed before 6 April 2022.

A Final Order is the current final divorce order.

It usually applies to divorce cases issued on or after 6 April 2022.

Both documents prove that a marriage or civil partnership has legally ended.

For Mexico, the practical question is simple:

Does the document clearly prove that the previous UK marriage ended, and has it been properly prepared for official use in Mexico?

3. Do Not Rely on a Loose PDF

Many clients only have a downloaded PDF or an old scan.

That may not be enough for a Mexican marriage application.

Before apostille, you should check:

  1. whether the document is a Decree Absolute or Final Order;
  2. whether it came from HMCTS or the court;
  3. whether it is an electronic PDF, court copy, scan or paper document;
  4. whether the names, dates, court details and case number are clear;
  5. whether a fresh HMCTS or court copy is needed;
  6. whether solicitor certification is required;
  7. whether the wording should refer to an electronic PDF court document;
  8. whether a Spanish translation will be required in Mexico.

Ginkgo Advisory can review the document and identify the safer route.

4. Why Solicitor Certification Matters

Some providers only write:

“I certify this is a true copy of the document presented to me.”

That wording may be too weak for overseas marriage use.

It may only confirm that someone showed a printout to the solicitor. It may not explain the document source, format, authenticity review or link to the court-issued document.

Ginkgo Advisory takes a stronger approach.

Where possible, we review the source and format first. We then prepare solicitor certification that fits the document.

For example, the wording may need to reflect that the document is:

  1. an HMCTS-issued copy;
  2. an electronic court PDF;
  3. a true copy of the original electronic divorce document;
  4. a court-sourced Decree Absolute or Final Order;
  5. a document prepared for FCDO apostille and Mexico marriage use.

We do not simply certify that a printout was presented.

We build a clearer document trail.

5. Electronic UK Divorce Orders Need Accurate Wording

Many modern England and Wales divorce orders are electronic documents.

They may show an electronic Family Court seal.

That does not make the divorce order invalid.

The issue is presentation.

A Mexican Civil Registry Office may not be familiar with UK electronic court documents. A loose printout can cause confusion. A solicitor-certified and apostilled document package gives the marriage office a clearer basis for acceptance.

The certification should describe the document accurately.

A PDF should be treated as a PDF.

An HMCTS copy should be linked to its source.

A scan should not be overstated.

Accuracy makes the apostille route stronger.

6. FCDO Apostille for Mexico

After solicitor certification, Ginkgo Advisory can arrange the UK FCDO apostille.

The apostille confirms the relevant UK signature, seal or stamp for international use. GOV.UK explains that the Legalisation Office checks signatures, stamps or seals and then attaches an apostille.

Mexico is a Hague Apostille Convention country. For UK documents used in Mexico, the key UK legalisation step is usually the FCDO apostille rather than Mexican Embassy legalisation.

In suitable cases, Ginkgo Advisory can arrange a 2 working days UK apostille service once the document is ready.

This can help if your Mexico wedding date is approaching and you need the divorce document prepared quickly.

7. Spanish Translation May Be Required

Mexican authorities may ask for a Spanish translation of the apostilled divorce document.

The Mexican Consulate in the UK states that foreign documents for marriage in Mexico must be apostilled or legalised in their country of origin and translated into Spanish by a registered translator in Mexico.

Translation requirements can vary by state, municipality and Civil Registry Office.

Before travel, confirm with the Mexican Civil Registry Office or wedding planner whether they require:

  1. Spanish translation;
  2. translation by a registered translator in Mexico;
  3. original apostilled divorce document;
  4. scanned copies before the wedding date;
  5. originals brought to Mexico;
  6. extra certified copies for future use.
