UK document legalisation for Malaysia can involve three separate stages. First, the document may need solicitor verification and certification. Next, it may require a UK FCDO Apostille. Finally, the Malaysian High Commission may need to attest the apostilled document.

Malaysia is a member of the Hague Conference on Private International Law. However, it has not become a Contracting Party to the 1961 Apostille Convention. An Apostille therefore does not automatically replace Malaysian consular legalisation.

Does Malaysia accept a UK Apostille?

Malaysia does not participate in the 1961 Apostille Convention. Consequently, an FCDO Apostille may be only one stage of the authentication process.

Some Malaysian employers, universities, banks and private organisations may accept an apostilled UK document without further attestation. Government bodies and regulated institutions may request an additional stamp from the Malaysian High Commission.

Requirements can differ between organisations. Applicants should therefore obtain written instructions from the requesting party in Malaysia before beginning the process.

What is solicitor verification and certification?

Ordinary true-copy certification confirms that a copy matches an original document shown to the solicitor.

That certification does not necessarily establish that the original was genuinely issued by the organisation named on it. A convincing-looking document could still be inaccurate or altered.

Authenticity verification provides a stronger evidential chain. Where a reliable verification route is available, we may check the document through:

  • The issuing university, school or professional body
  • An official digital verification portal
  • A secure QR code or document reference
  • Companies House or another public registry
  • Written confirmation from the issuing authority
  • The organisation’s registrar, records office or compliance department
  • Supporting identity and issuance records

Certification wording is then tailored to the checks actually completed. We do not state that authenticity has been confirmed unless suitable verification evidence has been obtained.

Enhanced authenticity-confirmation wording

Where the original has been independently verified, wording may follow this form:

I hereby certify that the attached document, namely the [document title] issued by [issuing institution or authority] to [document holder], is a true and complete copy of the original document produced to me. Having independently verified the document through the issuing institution’s official verification channel, I further confirm that the original document is authentic and was duly issued by [issuing institution or authority].

A shorter version may be appropriate in other cases:

I hereby certify that the attached [document title] is a true and complete copy of the original document produced to me, and that the authenticity of the original has been independently verified with the issuing authority.

When verification evidence is more limited, the wording must reflect that limitation. For example:

I hereby certify that the attached document is a true copy of the original produced to me. The document details have been checked against the official verification information available from the issuing authority.

This distinction matters. Certification should describe precisely what the solicitor inspected, confirmed or independently verified.

What does the FCDO Apostille confirm?

The FCDO Legalisation Office checks whether the signature, stamp or seal on a UK public document matches its records. If accepted, it attaches an Apostille certificate.

Documents that are not already UK public documents can often be apostilled after certification by a UK solicitor or notary. Examples include qualification certificates, powers of attorney, contracts and certified passport copies.

An Apostille confirms the authenticity of the relevant public official’s signature, seal or stamp. It does not independently approve every statement contained within the underlying document.

That limitation explains why enhanced solicitor verification can be valuable. A carefully prepared certification can create a clearer link between:

Which UK documents may require solicitor certification?

Private documents and document copies often need certification before the FCDO can issue an Apostille.

Certain public documents can usually be submitted directly to the FCDO. These may include official birth, marriage or death certificates, court documents and qualifying Companies House certificates.

Nevertheless, the Malaysian recipient may impose additional conditions. Some Malaysian High Commission procedures expressly refer to certification by a UK Notary Public rather than a solicitor. We therefore check whether solicitor certification will be accepted before preparing the document.

Express FCDO Apostille in 2 working days

The ordinary paper-based FCDO service can take up to 25 working days at busy periods. A next-working-day paper service is available only through eligible registered businesses, while restricted urgent applications require separate approval.

Ginkgo Advisory offers a 2-working-day express FCDO Apostille option for eligible and fully compliant documents.

This service target covers the FCDO Apostille stage after:

  • The correct original or certified document has reached us
  • Any necessary authenticity verification has finished
  • Suitable solicitor certification has been completed
  • The document has passed our pre-submission review
  • All required information and payment have been received

We arrange the submission through an eligible express provider route. The two-working-day period allows for document intake, final checks, express submission and recovery of the apostilled document.

Extra time may be needed when the FCDO must verify an unfamiliar signature. Delays may also arise if the issuer does not respond promptly or the document needs to be re-certified.

For Malaysian High Commission attestation, a paper Apostille is normally the appropriate format. A physical document is required for the subsequent consular submission.

Malaysian High Commission attestation in London

Once the FCDO Apostille has been attached, we can arrange attestation by the Malaysian High Commission where the Malaysian recipient requires it.

Malaysian High Commission fee

The published consular legalisation fee is £5 per document. This is a government disbursement and is separate from verification, certification, Apostille, handling, courier and professional service fees.

Following a payment change introduced on 24 March 2026, consular counters no longer accept cash. Payments must be made electronically.

Any consular fee already paid should be treated as non-refundable after submission. A rejected application may therefore result in the loss of the consular disbursement.

Malaysian attestation processing time

We currently advise clients to allow approximately 11–20 working days for the Malaysian High Commission stage.

This is a planning estimate rather than a guaranteed deadline. Processing can take longer where:

  • Additional checks are required
  • The document type is unusual
  • A public holiday interrupts the submission schedule
  • The High Commission refers the document for further approval
  • Supporting documents are missing or inconsistent
  • The Apostille or certification wording is not accepted

The express FCDO option does not accelerate the Malaysian High Commission’s internal processing.

Passport-copy requirements

Our Malaysian attestation submission checklist normally includes a clear copy of the document holder’s passport.

For a marriage certificate or Certificate of No Impediment, passport copies for both parties should be provided. Names should match the document and the Apostille application.

A discrepancy involving names, dates of birth or document numbers should be addressed before submission. Unexplained differences can result in delay or rejection.

Each document must be assessed individually. Corporate records downloaded from Companies House may follow a different route from privately signed board resolutions or contracts.

Can a foreign document be certified and apostilled in the UK?

A document issued outside the United Kingdom cannot automatically receive a UK Apostille merely because its holder lives in Britain.

The FCDO legalises the signature, seal or stamp of a qualifying UK public official. It does not directly legalise the signature of every foreign issuer.

Some foreign documents can be presented to a UK solicitor or notary and prepared through a UK certification route. Others must first be authenticated in the country where they were issued.

Malaysian official guidance states that where legalisation cannot be completed in the UK, the document should be legalised by the foreign ministry of the issuing country and then by the Malaysian embassy in that country.

Before accepting a foreign document, we check:

  • Its country of issue
  • Whether the original is available
  • The type of issuing authority
  • Whether a UK solicitor or notary can lawfully certify it
  • Whether the FCDO can apostille the resulting certification
  • Whether the Malaysian High Commission will accept that route
  • Whether legalisation must instead be completed in the country of origin

Sending a scan for assessment before posting the original can prevent unnecessary expense.

A document may encounter difficulties where the wrong legalisation chain has been used.

  • Certification that only says “true copy” when authenticity confirmation was requested
  • An authenticity statement unsupported by independent verification
