Getting married in Mauritius after a previous UK marriage?
Your UK divorce document may need careful preparation before the Mauritian Civil Status Office accepts it.
If your previous marriage ended in England or Wales, the key document is usually a Decree Absolute or Final Order. For Mauritius, that document should usually be properly certified and apostilled before submission.
Ginkgo Advisory helps clients prepare UK divorce documents for Mauritius through a clear route:
UK court document → source review → solicitor certification → FCDO apostille → Mauritius use
We do not simply stamp a printout. We help build a stronger document trail for overseas use.
1. Why Mauritius May Ask for a UK Divorce Document
Mauritius requires proof of a previous divorce where a person has been married before. The Mauritius Civil Status Division states that a divorce decree abroad should be produced in original and should be apostilled for marriage purposes.
This means a UK divorce document may be needed for:
- civil marriage in Mauritius;
- remarriage in Mauritius after a UK divorce;
- marriage paperwork before the Civil Status Office;
- proof that a previous UK marriage has legally ended;
- marriage applications involving foreign nationals;
- supporting documents requested by a wedding planner, lawyer or local authority;
- other official civil status use in Mauritius.
The final checklist can depend on the Civil Status Office, the parties’ nationality, the timing of the marriage application and the local requirements at the time of submission.
2. Decree Absolute or Final Order: What Should You Use?
A Decree Absolute is the older final divorce order in England and Wales.
It usually applies to divorces completed before 6 April 2022.
A Final Order is the current final divorce order.
It usually applies to divorce cases issued on or after 6 April 2022.
Both documents prove the same core point: the previous marriage or civil partnership has legally ended.
For Mauritius, the important question is not only the name of the document. The important question is whether the document is clear, reliable, properly certified where needed, and apostilled for overseas use.
3. The Better Route for Mauritius
Many people start with an old PDF or scan.
That can create risk.
A stronger route usually works like this:
Step 1: Review the UK divorce document
Check whether the document is a Decree Absolute, Final Order, court PDF, HMCTS copy, scan or older paper document.
Step 2: Check the source
Where possible, confirm whether the document came from HMCTS or the relevant court record.
Step 3: Prepare solicitor certification
Use wording that matches the real format of the document.
Step 4: Arrange FCDO apostille
The UK Legalisation Office legalises UK documents by checking the relevant signature, stamp or seal and attaching an apostille.
Step 5: Submit for Mauritius use
The apostilled document can then be prepared for the Mauritian marriage or civil status process, subject to the receiving authority’s requirements.
4. Why an Old PDF May Not Be Enough
A downloaded divorce PDF may be genuine.
But it may still cause practical problems abroad.
Before sending the document for apostille, check:
- whether the names, dates and case number are clear;
- whether the court details are visible;
- whether the electronic Family Court seal appears properly;
- whether the document is an original court PDF or just a scan;
- whether a fresh HMCTS or court copy would be safer;
- whether solicitor certification is needed before FCDO apostille.
Ginkgo Advisory can review the document and identify the stronger route.
5. Why Solicitor Certification Matters
Some providers only certify a document with wording such as:
“I certify this is a true copy of the document presented to me.”
这种措辞对于海外使用而言,可能力度不足。
It may only say that someone showed the solicitor a printout. It may not explain the source, format, authenticity review or connection to the UK court-issued document.
Ginkgo Advisory takes a more careful approach.
Where possible, we review the document source and format first. Then we prepare solicitor certification wording that fits the document.
For example, the wording may refer to:
- an HMCTS-issued copy;
- an electronic court PDF;
- a true copy of an original electronic divorce document;
- a court-sourced Decree Absolute or Final Order;
- a document prepared for FCDO apostille and Mauritius marriage use.
This creates a clearer document trail than a basic copy stamp.
6. Electronic UK Divorce Orders
Many modern divorce orders from England and Wales are electronic documents.
They may contain an electronic image of the Family Court seal.
That does not make the divorce order invalid.
The issue is presentation.
A Mauritian authority may not be familiar with the UK electronic court format. A solicitor-certified and apostilled package can make the document easier to understand.
The certification should describe the document accurately.
A PDF should be treated as a PDF.
An HMCTS copy should be linked to HMCTS.
A scan should not be overstated.
Accurate wording supports a stronger apostille application and a clearer Mauritius-use package.
7. FCDO Apostille for Mauritius
After solicitor certification, Ginkgo Advisory can arrange the UK 英国 FCDO 海牙认证.
The apostille confirms the relevant UK signature, stamp or seal for international use. GOV.UK states that the Legalisation Office checks signatures, stamps or seals and legalises documents by attaching an apostille.
In suitable cases, Ginkgo Advisory can arrange a 2 个工作日英国 apostille 服务 once the document is ready.
This can help where a Mauritius wedding date, civil marriage appointment or document submission deadline is approaching.
8. Translation and Local Requirements
Mauritius uses English in many official processes, but the final document checklist can still vary.
Before submission, confirm whether the receiving authority needs:
- the original apostilled divorce document;
- a solicitor-certified copy;
- a fresh HMCTS or court copy;
- certified translation, if any supporting document is not in English;
- scanned copies before the appointment;
- physical originals for filing;
- any additional certificate of celibacy, affidavit or proof of free status.
The Civil Status Division also lists certificate of celibacy arrangements for Mauritian citizens residing abroad, so parties should check whether any separate free-status document applies to their situation.
