British Nationals Getting Married in Germany

If you are a British national planning to get married in Germany, you must follow the German marriage process.

The UK Government guidance explains that your marriage will usually be recognised in the UK if:

you follow the correct process under German law;
and the marriage would be allowed under UK law.

Your marriage will be registered in Germany, not in the UK. You will not be able to register the marriage later at a UK register office, British Embassy or British Consulate.

You should keep your German marriage certificate as evidence of your marriage. If you need to use it outside Germany, you may also need a translation.


Check With the Standesamt First

Before preparing UK documents, contact the local German registry office.

In Germany, this is called the Standesamt.

The Standesamt can confirm:

which documents you need;
whether you need translations;
whether any UK document needs an apostille;
whether you need a Certificate of No Impediment;
whether you need an exemption from the German certificate of capacity to marry process;
how long the document review may take.

This step matters because the German authority will decide what it needs for your marriage registration.


If You Live in Germany

If you live in Germany, you may need an exemption called:

Befreiung von der Beibringung des Ehefähigkeitszeugnisses

This means an exemption from providing a certificate of capacity to marry.

The exemption usually comes from the Higher Regional Court, known in German as the Oberlandesgericht.

The relevant court is usually the Oberlandesgericht responsible for the registration district where you live.

Your local Standesamt should guide you through this process.

The Standesamt may ask for UK documents to support the exemption application. These may include identity documents, proof of marital status, divorce documents, translations or apostilles.


If You Live in the UK

If you live in the UK, the process may be different.

The UK Government guidance says that British nationals living in the UK usually need a Certificate of No Impediment, also known as a CNI, from a UK register office.

You should follow the guidance for British nationals living in the UK.

A CNI is a document that confirms that no legal impediment to your marriage has been shown to exist.

Before applying, ask the German Standesamt whether it needs a CNI and whether the CNI must be apostilled or translated.


If You Live Outside Germany and Outside the UK

If you live in another country, you should contact the German Standesamt where you intend to marry.

The Standesamt can confirm the specific process for your situation.

Your route may depend on:

your nationality;
your residence country;
your marital history;
the documents available from your country of residence;
and the German authority handling your marriage registration.

Do not assume that the UK-resident route applies if you live elsewhere.


If You Were Previously Married or in a Civil Partnership

If you were previously married or in a civil partnership, the German authority may ask for proof that the previous relationship has ended.

For England and Wales, this usually means a:

Decree Absolute;
or Final Order.

A Decree Absolute is the older final divorce order. It usually applies to divorces completed before 6 April 2022.

A Final Order is the current final divorce order. It usually applies to divorce cases issued on or after 6 April 2022.

Both documents prove that the previous marriage has legally ended.

The Standesamt may ask for the original, a certified copy, an apostille, a translation, or supporting evidence. Always check before submitting documents.


If You Do Not Have Your UK Divorce Document

Many British nationals no longer have a clear copy of their Decree Absolute or Final Order.

Some clients only hold:

an old scan;
a blurred photo;
a downloaded PDF;
a court email attachment;
an electronic divorce order;
or an unclear copy from an old file.

This may create problems if the German Standesamt needs a clear official divorce document.

Digital Divorce Orders Need Care

Modern UK divorce documents may exist as electronic court documents.

A German authority may not be familiar with the format of an English electronic divorce order.

A loose printout may not explain the document clearly. It may also fail to show the source trail.

A stronger route may include:

reviewing the UK court document;
checking whether it is a court PDF, HMCTS copy or paper order;
preparing solicitor certification;
arranging a UK FCDO apostille where needed;
then arranging German translation if the Standesamt requires it.

This gives the German authority a clearer document chain.


Do You Need an Apostille for Germany?

Germany and the UK both use the apostille system.

If the German Standesamt asks for a UK document to be legalised, this usually means a 英国 FCDO 海牙认证.

For UK divorce documents, the common route may be:

UK divorce document → solicitor certification → UK FCDO apostille → German translation if required → use at the Standesamt

The exact requirement depends on the German authority.

Some Standesamt offices may require certified translations by a recognised translator. Some may also want documents issued within a certain period.

You should confirm the document format, apostille requirement and translation requirement before you start.


Marriage Registration in Germany

A marriage that takes place in Germany will be registered in Germany.

It will not be added to UK marriage records.

You cannot obtain a German marriage certificate from a UK register office, British Embassy or British Consulate.

The German authority or the person conducting the ceremony can explain how to obtain the German marriage certificate.

You should keep the certificate safely. If you plan to use it outside Germany, you may need a translation or apostille depending on the destination country.
