British Nationals Getting Married in Portugal

If you are a British national planning to get married in Portugal, you must follow the Portuguese marriage process.

Your marriage will usually be recognised in the UK if:

you follow the correct process under Portuguese law;
and the marriage would be allowed under UK law.

The Portuguese registration authority or the person conducting your ceremony can confirm which documents you need.

Unlike many other European countries, Portugal does not usually require a Certificate of No Impediment, also known as a CNI, from British nationals who live in Portugal or another country outside the UK.

This point is important. It means the Portugal process can look different from Spain, Italy, Poland or Romania.


No Certificate of No Impediment for Many British Nationals

British nationals who live in Portugal or another country outside the UK do not need to produce a CNI for marriage in Portugal.

The British Embassy notice states that this position was first agreed by the Portuguese Instituto dos Registos e do Notariado in August 2013 and reconfirmed in April 2025. The same notice says British nationals in this situation should be treated in the same way as Portuguese nationals.

This means you should not assume that you need a UK CNI for Portugal.

Instead, contact the Portuguese civil registration office early and ask what documents they require for your case.


Check the Portuguese Registration Authority First

Before preparing UK documents, contact the Portuguese registration authority.

This may be a local Conservatória do Registo Civil or another Portuguese civil registration office.

They can confirm:

which documents you need;
whether you need translations;
whether any UK document needs an apostille;
whether your divorce document needs extra evidence;
whether your documents must be recent;
how the marriage will be registered in Portugal.

The British Embassy notice also advises British nationals to contact the Portuguese registration authorities early to obtain detailed local requirements.

This step matters because local requirements may vary.


Marriage Registration in Portugal

If you marry in Portugal, your marriage will be registered in Portugal.

It will not be added to UK marriage records.

You cannot register the marriage later at a UK register office, British Embassy or British Consulate.

You should keep your Portuguese marriage certificate as evidence of your marriage.

If you want to use the certificate outside Portugal, you may need a translation or apostille.


You Were Previously Married

If you were previously married, the Portuguese authority may ask for proof that the previous marriage has ended.

For England and Wales, this usually means a:

Decree Absolute;
or Final Order.

A Decree Absolute is the older final divorce order. It usually applies to divorces completed before 6 April 2022.

A Final Order is the current final divorce order. It usually applies to divorce cases issued on or after 6 April 2022.

Both documents prove that the previous marriage has legally ended.

The Portuguese authority may ask for the original, a certified copy, an apostille, a translation, or supporting court evidence. Always check before submitting documents.


If You Do Not Have Your UK Divorce Document

Many British nationals no longer have a clear copy of their Decree Absolute or Final Order.

Some only hold:

an old scan;
a downloaded PDF;
a blurred photo;
a court email attachment;
an electronic divorce order;
or an unclear copy from an old file.

This may cause problems if the Portuguese authority needs clear proof that your previous marriage has ended.

Digital Divorce Orders Need Care

Modern UK divorce documents may exist as electronic court documents.

Some come as court PDFs. Others may come with a covering email from the court.

A Portuguese civil registration office may not be familiar with the format of an English electronic divorce order.

A loose printout may not explain the document clearly. It may also fail to show the source trail.

A stronger route may include:

reviewing the UK court document;
checking whether it is a court PDF, HMCTS copy or paper order;
preparing solicitor certification;
arranging a UK FCDO apostille where needed;
then arranging Portuguese translation if required.

This gives the Portuguese authority a clearer document chain.


Do You Need an Apostille for Portugal?

You should check this with the Portuguese registration authority.

Portugal and the UK both use the apostille system.

If a Portuguese authority asks for a UK document to be legalised, this usually means a 英国 FCDO 海牙认证.

For UK divorce documents, the common route may be:

UK divorce document → solicitor certification → UK FCDO apostille → Portuguese translation if required → use in Portugal

This route can help where the document is a court PDF, electronic Final Order, unclear scan or certified copy.

Why Portugal Is Different From Other CNI Countries

Many British nationals expect to apply for a CNI before marrying in Europe.

That may be necessary in some countries.

Portugal is different for British nationals who live in Portugal or outside the UK. The British Embassy notice confirms that these British nationals are not required to produce a CNI for marriage in Portugal.

This does not mean you have no paperwork.

It means the Portuguese authority will tell you what documents it needs under the local process.

For many applicants, the practical issue is not the CNI. The key issue is preparing UK supporting documents correctly, especially if there was a previous marriage or divorce.
