British Nationals Getting Married in China
If you are a British national planning to marry a Chinese national in mainland China, you usually need to prove that you are legally free to marry.
The UK Government guidance, “Confirm you’re free to get married in China”, explains the main steps. The process is different from getting married in the UK. You need to check local Chinese rules, prepare the right documents and arrange a marital status affirmation through the British Embassy or British Consulate in China.
Many people also need UK documents to support the process.
If you were previously married or in a civil partnership, you may need proof that the relationship has legally ended. For England and Wales, this usually means a Decree Absolute or Final Order.

Check the Local Civil Affairs Bureau First
Before you book travel or make an appointment, contact the local Civil Affairs Bureau. In Chinese, this is usually called Min Zheng Ju / 民政局.
In most provinces, you need to marry in the city or province shown on your Chinese partner’s household register / Hukou / 户口.
The local Civil Affairs Bureau can confirm:
where you can register the marriage;
what documents you need;
whether your affirmation needs Chinese translation;
how recent your documents must be;
whether any foreign divorce documents need extra preparation.
This step matters. Requirements may vary between provinces, cities and local marriage offices.
Marital Status Affirmation for British Nationals
To get married in China, a British national usually needs a marital status affirmation.
This is a sworn statement. It confirms that you are free to marry.
According to UK Government guidance, you need to apply online, pay the fee and book an appointment at one of these locations:
British Embassy Beijing
British Consulate General Shanghai
British Consulate General Guangzhou
At the appointment, you make your declaration and sign your affirmation. You usually receive the affirmation at the end of the appointment.
Book your appointment at least 7 days after you apply online. This gives consular staff time to check your documents.
Documents Needed for the Online Application
To apply for the marital status affirmation, you normally need:
your UK passport;
proof of your permanent address;
your partner’s Chinese identity card;
your partner’s household register / Hukou;
proof that any previous marriage or civil partnership has ended;
a Visa or Mastercard to pay the fee.
You may need a certified translation if a document is not in English or Chinese.
You must also bring the originals of the documents you uploaded. If you do not bring the originals, the consular office may not issue the affirmation. You may then need to book another appointment.
If You Were Previously Married or in a Civil Partnership
If you or your partner has been married or in a civil partnership before, you need proof that the previous relationship has ended.
The UK Government guidance lists several possible documents, including:
a Decree Absolute or Final Order;
an annulment certificate;
a civil partnership dissolution;
a death certificate and marriage certificate, where relevant.
For England and Wales divorce cases, the key document is usually the Decree Absolute or Final Order.
A Decree Absolute is the older final divorce order. It usually applies to divorces completed before 6 April 2022.
A Final Order is the current final divorce order. It usually applies to divorce cases issued on or after 6 April 2022.
Both documents show that the previous marriage has legally ended.
What If You Do Not Have the Original Divorce Document?
Many clients no longer have their original Decree Absolute or Final Order.
Some only have an old scan, a downloaded PDF, a blurred photo or a copy from an old email.
UK Government guidance says you can order a UK Decree Absolute or Final Order if you do not have the original. This applies to divorce, dissolution or annulment records.

Do You Need an Apostille for China?
China has joined the Hague Apostille Convention. As a result, many UK public documents for mainland China can now use a 英国 FCDO 海牙认证. They do not usually need Chinese embassy legalisation.
However, you should still check with the local Chinese authority. The Civil Affairs Bureau may tell you whether your UK divorce document needs an apostille.
For divorce documents, many clients choose this safer route:
obtain the UK court document → solicitor certification → UK FCDO apostille → use in China
This route can help where the document is not a traditional wet-ink court document. It is also useful for a court PDF or electronic divorce order.
Why Solicitor Certification May Be Needed
The UK FCDO does not legalise every loose PDF or scan automatically.
Some documents need a UK solicitor’s signature before apostille. In these cases, the wording matters.
A weak certification may only say:
“I certify this is a true copy of the document presented to me.”
This wording may not explain the source or format of the document. It may also fail to explain the court issue trail.

Important Timing Points
Most Civil Affairs Bureaus only accept documents issued within a certain number of months. The exact period depends on the place where you plan to marry.
You should check:
how recent your marital status affirmation must be;
whether your divorce document needs an apostille;
whether Chinese translation is required;
whether your Civil Affairs Bureau accepts your document format;
whether you need to bring originals to your consular appointment.
Do not leave the UK divorce document or apostille until the last minute. If the court copy takes time, your whole marriage document timetable may change.
