Need to use a UK divorce document in France?

You may need more than a printed court PDF.

If your previous marriage ended in England or Wales, a French authority may ask for an apostilled Decree Absolute or Final Order before it accepts that you are divorced.

This is common when you need the document for:

  1. remarriage in France;
  2. a civil marriage file at the mairie;
  3. French civil status records;
  4. a notaire;
  5. French property sale or transfer;
  6. inheritance or succession;
  7. French court or legal proceedings;
  8. residence, nationality, passport or consular matters.

Ginkgo Advisory helps clients prepare UK divorce documents for France with solicitor certification, source-based review, FCDO apostille and France-ready document presentation.

1. France Needs a Clear Document Trail

A UK divorce document may be valid in England and Wales.

But for France, the document must also be suitable for official overseas use.

A stronger route usually looks like this:

UK court document → solicitor review → solicitor certification → FCDO apostille → French translation if required → use in France

This route works better than relying on a loose scan, unclear copy or uncertified printout.

It helps the French authority see where the document came from, who certified it, and how it was legalised for international use.

GOV.UK confirms that the UK Legalisation Office checks the relevant signature, stamp or seal and legalises the document by attaching an apostille.

2. Decree Absolute or Final Order?

A Decree Absolute is the older final divorce order in England and Wales.

It usually applies to divorces completed before 6 April 2022.

A Final Order is the current final divorce order.

It usually applies to divorce cases issued on or after 6 April 2022.

Both documents prove that a marriage or civil partnership has legally ended.

For French use, the name matters less than the preparation. The French authority usually wants the document to be clear, properly certified, apostilled and translated where required.

3. When You May Need This Document in France

Clients often need a UK Decree Absolute or Final Order for:

  1. getting married again in France;
  2. proving divorce status to a French mairie;
  3. preparing a civil marriage file;
  4. updating French civil status records;
  5. dealing with a French notaire;
  6. buying, selling or transferring property in France;
  7. handling inheritance, succession or estate matters;
  8. filing documents in a French court;
  9. supporting residence, nationality, visa or consular applications.

French notarial guidance lists court judgments and judicial decisions among documents that may require apostille or legalisation, depending on the destination and use.

4. Why an Old PDF May Cause Problems

Many clients only have an old scan or downloaded PDF.

That may not be the best version for France.

Before apostille, check:

  1. 文件是 Decree Absolute 還是 Final Order;
  2. whether the copy came from HMCTS or the court;
  3. whether it is an electronic PDF, court copy, scan or older paper document;
  4. whether the names, dates, case number and court details are clear;
  5. whether the electronic Family Court seal appears properly;
  6. whether a fresh HMCTS or court copy would create a stronger starting point;
  7. whether solicitor certification is required before apostille.

Ginkgo Advisory can review the document and identify the safer route.

5. Stronger Solicitor Certification for France

Some providers only certify a document with wording such as:

“I certify this is a true copy of the document presented to me.”

That may be too basic for overseas use.

It may only confirm that someone showed a printout to the solicitor. It may not explain the source, format or link to the UK court-issued document.

Ginkgo Advisory takes a more careful approach.

Where possible, we review the document source and format before certification. We then use wording that reflects the real document.

For example, certification may refer to:

  1. an HMCTS-issued copy;
  2. an electronic court PDF;
  3. a true copy of an original electronic divorce document;
  4. a court-sourced Decree Absolute or Final Order;
  5. a document prepared for FCDO apostille and use in France.

We do not simply certify that a printout was presented.

We help build a stronger document trail.

6. Electronic UK Divorce Orders

Many modern divorce orders from England and Wales are electronic documents.

They may show an electronic Family Court seal.

That does not make the document invalid.

The issue is presentation.

A French mairie, notaire or court may not be familiar with UK electronic court documents. A solicitor-certified and apostilled package can help explain the document more clearly.

The wording should match the document.

A PDF should be described as a PDF.
An HMCTS copy should link back to HMCTS.
A scan should not be overstated.

Accurate wording supports a better apostille application and a cleaner France-use package.

7. FCDO Apostille for France

After solicitor certification, Ginkgo Advisory can arrange the UK 英国 FCDO 海牙认证.

The apostille confirms the relevant UK signature, stamp or seal for overseas use.

France is a Hague Apostille Convention country. In most France-use cases, a UK document needs the FCDO apostille rather than French consular legalisation.

In suitable cases, Ginkgo Advisory can arrange a 2 个工作日英国 apostille 服务 once the document is ready.

This can help if you face a deadline for marriage, mairie filing, succession, property completion, notarial signing, court filing or consular submission in France.

8. French Translation

A French authority may also ask for a French translation.

Depending on the use, this may need to be:

  1. a certified translation;
  2. a sworn translation by a traducteur assermenté;
  3. a translation accepted by the relevant mairie, notaire, court or authority;
  4. a translation arranged through a locally accepted route.

Translation rules can vary. Always check the final requirement with the French authority receiving the document.

Ginkgo Advisory can prepare the UK-side document trail so the apostilled divorce document is ready for the next step.
