If you got divorced in England or Wales, and your marriage is registered in Italy, you may need to register your UK divorce with the Italian Consulate General in London.

This step matters because Italy must update your civil status before you can rely on your divorce for many Italian legal or family matters. For example, you may need the update before you remarry, register a future child, or correct your Italian records.

However, the process can feel confusing. A UK Divorce Final Order or Decree Absolute often needs solicitor certification, a UK FCDO paper Apostille, and an Italian translation before you send it to the Italian Consulate.

Ginkgo Advisory helps clients prepare UK divorce documents for Italian consular use.

Key Points

  • You may need to register your UK divorce in Italy if your marriage appears in the Italian civil register.
  • The Italian Consulate General in London asks for specific documents.
  • Your UK Divorce Final Order or Decree Absolute normally needs solicitor, notary, or court certification.
  • The document also needs a UK FCDO paper Apostille.
  • The Italian Consulate does not accept an e-Apostille for this process.
  • You need an Italian translation of the divorce document.
  • You do not need to translate the Apostille.
  • If HMCTS sent your divorce order by email, you should also include the original court email.
  • Ginkgo Advisory can assist with solicitor certification and the UK FCDO paper Apostille.

Who May Need This Service?

You may need this service if:

  • you are an Italian citizen living in the UK;
  • you married in Italy;
  • your marriage appears in an Italian Comune;
  • you got divorced in England or Wales;
  • you received a UK Divorce Final Order or Decree Absolute;
  • you need to update your marital status in Italy;
  • you plan to remarry;
  • you are expecting a child and need your Italian records to be correct; or
  • you need the Italian authorities to recognise your UK divorce.

Marriage Registration Comes First

Before you register a divorce, the Italian Consulate normally checks whether Italy has already registered the marriage.

Therefore, your marriage should already appear in the Italian civil register.

If Italy has not registered the marriage yet, you may need to deal with that first. After that, you can move on to the divorce registration.

Main UK Divorce Document

For a divorce from England and Wales, you will usually need one of these documents:

  • Decree Absolute
    This applies to older divorce cases.
  • Divorce Final Order
    This applies to newer divorce cases.

Both documents confirm that the UK court has finalised the divorce.

However, for Italian consular use, the document usually needs extra steps before you submit it.

Certification Requirement

The Italian Consulate asks for wording that confirms the divorce document is a true copy of the original document filed with the court.

A District Judge, solicitor, or notary public can provide this wording.

In many digital divorce cases, solicitor certification offers a practical route.

Why Solicitor Certification Helps

Many clients now receive their Divorce Final Order as a PDF from HM Courts & Tribunals Service.

A PDF alone may not meet the Italian Consulate’s requirements.

Therefore, a solicitor can review the document and certify it as a true copy. After that, the document can go to the UK Foreign, Commonwealth & Development Office for a paper Apostille.

This step helps you prepare the document for use in Italy.

Paper Apostille Required

For divorce registration at the Italian Consulate General in London, you need a paper Apostille.

This is a key point.

The Italian Consulate does not accept an e-Apostille for this process. Therefore, even if an e-Apostille works for other countries or other document types, it is not suitable here.

The UK FCDO attaches the paper Apostille to the certified divorce document. You can then use the legalised document for your Italian Consulate application.

What If HMCTS Sent the Divorce Order by Email?

If HMCTS sent your Divorce Final Order by email, the Italian Consulate asks you to include the court email with your application.

This usually means the original HMCTS email that enclosed your Divorce Final Order.

You do not need an Apostille for the email. Also, you do not need to translate the email.

Even so, you should still include it because it shows how the UK court sent the digital divorce document.

For verification, Ginkgo Advisory normally asks clients to provide the original HMCTS email in .EML format.

How to Download the HMCTS Email from Gmail

If you use Gmail, you can download the email by following these steps:

  • Open the HMCTS email.
  • Click the three dots next to the reply button.
  • Select “Download message”.
  • Save the file as an .EML file.
  • Send the .EML file together with your Divorce Final Order.

This helps us check the source of the digital court document before solicitor certification.

Italian Translation

You also need an Italian translation of the Divorce Final Order or Decree Absolute.

However, the translation does not need an Apostille.

In addition, the Apostille itself does not need translation.

You may use a certified translator, including a translator from the list provided by the Italian Consulate General in London.

Where needed, Ginkgo Advisory can help you obtain quotes from Italian translators who handle UK legal and civil status documents.

What If There Are Children?

If there are minor children, the Italian Consulate may ask for extra documents.

For example, you may need to provide:

  • child arrangement documents;
  • an agreement for children;
  • confirmation that the UK court did not deal with child matters;
  • proof of agreement between the parties; or
  • a statutory declaration in Italian.

Some child-related documents may also need solicitor certification, a UK FCDO Apostille, and Italian translation.

However, if there were no children from the previous marriage, the process is usually simpler.

What If One Party Did Not Appear?

If one party did not take part in the divorce proceedings, the Italian Consulate may ask for more evidence.

For example, you may need to provide:

  • confirmation that the Respondent received notice;
  • an Acknowledgement of Service;
  • solicitor, notary, or court certification;
  • a UK FCDO Apostille; and
  • an Italian translation.

This depends on the facts of your divorce case.

Typical Document Checklist

A standard application may include:

  • completed Italian Consulate application form;
  • signed declaration form;
  • copy of valid ID;
  • UK Divorce Final Order or Decree Absolute;
  • solicitor, notary, or court certification;
  • UK FCDO paper Apostille;
  • Italian translation of the divorce document;
  • original HMCTS email, if HMCTS sent the document by email;
  • child-related documents, if relevant;
  • default of appearance documents, if relevant; and
  • Special Delivery envelope, if the Consulate asks for one.
