British Nationals Getting Married in Germany<\/h2>\n\n\n\n

If you are a British national planning to get married in Germany, you must follow the German marriage process.<\/p>\n\n\n\n

The UK Government guidance explains that your marriage will usually be recognised in the UK if:<\/p>\n\n\n\n

you follow the correct process under German law;
and the marriage would be allowed under UK law.<\/p>\n\n\n\n

Your marriage will be registered in Germany, not in the UK. You will not be able to register the marriage later at a UK register office, British Embassy or British Consulate.<\/p>\n\n\n\n

You should keep your German marriage certificate as evidence of your marriage. If you need to use it outside Germany, you may also need a translation.<\/p>\n\n\n\n

\n\n\n\n

Check With the Standesamt First<\/h2>\n\n\n\n

Before preparing UK documents, contact the local German registry office.<\/p>\n\n\n\n

In Germany, this is called the Standesamt<\/strong>.<\/p>\n\n\n\n

The Standesamt can confirm:<\/p>\n\n\n\n

which documents you need;
whether you need translations;
whether any UK document needs an apostille;
whether you need a Certificate of No Impediment;
whether you need an exemption from the German certificate of capacity to marry process;
how long the document review may take.<\/p>\n\n\n\n

This step matters because the German authority will decide what it needs for your marriage registration.<\/p>\n\n\n\n

\n\n\n\n

If You Live in Germany<\/h2>\n\n\n\n

If you live in Germany, you may need an exemption called:<\/p>\n\n\n\n

Befreiung von der Beibringung des Ehef\u00e4higkeitszeugnisses<\/strong><\/p>\n\n\n\n

This means an exemption from providing a certificate of capacity to marry.<\/p>\n\n\n\n

The exemption usually comes from the Higher Regional Court<\/strong>, known in German as the Oberlandesgericht<\/strong>.<\/p>\n\n\n\n

The relevant court is usually the Oberlandesgericht responsible for the registration district where you live.<\/p>\n\n\n\n

Your local Standesamt<\/strong> should guide you through this process.<\/p>\n\n\n\n

The Standesamt may ask for UK documents to support the exemption application. These may include identity documents, proof of marital status, divorce documents, translations or apostilles.<\/p>\n\n\n\n

\n\n\n\n

If You Live in the UK<\/h2>\n\n\n\n

If you live in the UK, the process may be different.<\/p>\n\n\n\n

The UK Government guidance says that British nationals living in the UK usually need a Certificate of No Impediment<\/strong>, also known as a CNI<\/strong>, from a UK register office.<\/p>\n\n\n\n

You should follow the guidance for British nationals living in the UK.<\/p>\n\n\n\n

A CNI is a document that confirms that no legal impediment to your marriage has been shown to exist.<\/p>\n\n\n\n

Before applying, ask the German Standesamt whether it needs a CNI and whether the CNI must be apostilled or translated.<\/p>\n\n\n\n

\n\n\n\n

If You Live Outside Germany and Outside the UK<\/h2>\n\n\n\n

If you live in another country, you should contact the German Standesamt where you intend to marry.<\/p>\n\n\n\n

The Standesamt can confirm the specific process for your situation.<\/p>\n\n\n\n

Your route may depend on:<\/p>\n\n\n\n

your nationality;
your residence country;
your marital history;
the documents available from your country of residence;
and the German authority handling your marriage registration.<\/p>\n\n\n\n

Do not assume that the UK-resident route applies if you live elsewhere.<\/p>\n\n\n\n

\n\n\n\n

If You Were Previously Married or in a Civil Partnership<\/h2>\n\n\n\n

If you were previously married or in a civil partnership, the German authority may ask for proof that the previous relationship has ended.<\/p>\n\n\n\n

For England and Wales, this usually means a:<\/p>\n\n\n\n

Decree Absolute<\/strong>;
or Final Order<\/strong>.<\/p>\n\n\n\n

A Decree Absolute<\/strong> is the older final divorce order. It usually applies to divorces completed before 6 April 2022.<\/p>\n\n\n\n

A Final Order<\/strong> is the current final divorce order. It usually applies to divorce cases issued on or after 6 April 2022.<\/p>\n\n\n\n

Both documents prove that the previous marriage has legally ended.<\/p>\n\n\n\n

The Standesamt may ask for the original, a certified copy, an apostille, a translation, or supporting evidence. Always check before submitting documents.<\/p>\n\n\n\n

\n\n\n\n

If You Do Not Have Your UK Divorce Document<\/h2>\n\n\n\n

Many British nationals no longer have a clear copy of their Decree Absolute or Final Order.<\/p>\n\n\n\n

Some clients only hold:<\/p>\n\n\n\n

an old scan;
a blurred photo;
a downloaded PDF;
a court email attachment;
an electronic divorce order;
or an unclear copy from an old file.<\/p>\n\n\n\n

This may create problems if the German Standesamt needs a clear official divorce document.<\/p>\n\n\n\n

Digital Divorce Orders Need Care<\/h2>\n\n\n\n

Modern UK divorce documents may exist as electronic court documents.<\/p>\n\n\n\n

A German authority may not be familiar with the format of an English electronic divorce order.<\/p>\n\n\n\n

A loose printout may not explain the document clearly. It may also fail to show the source trail.<\/p>\n\n\n\n

A stronger route may include:<\/p>\n\n\n\n

reviewing the UK court document;
checking whether it is a court PDF, HMCTS copy or paper order;
preparing solicitor certification;
arranging a UK FCDO apostille where needed;
then arranging German translation if the Standesamt requires it.<\/p>\n\n\n\n

This gives the German authority a clearer document chain.<\/p>\n\n\n\n

\n\n\n\n

Do You Need an Apostille for Germany?<\/h2>\n\n\n\n

Germany and the UK both use the apostille system.<\/p>\n\n\n\n

If the German Standesamt asks for a UK document to be legalised, this usually means a \u82f1\u56fd FCDO \u6d77\u7259\u8ba4\u8bc1<\/strong>.<\/p>\n\n\n\n

For UK divorce documents, the common route may be:<\/p>\n\n\n\n

UK divorce document \u2192 solicitor certification \u2192 UK FCDO apostille \u2192 German translation if required \u2192 use at the Standesamt<\/strong><\/p>\n\n\n\n

The exact requirement depends on the German authority.<\/p>\n\n\n\n

Some Standesamt offices may require certified translations by a recognised translator. Some may also want documents issued within a certain period.<\/p>\n\n\n\n

You should confirm the document format, apostille requirement and translation requirement before you start.<\/p>\n\n\n\n

Marriage Registration in Germany<\/h2>\n\n\n\n

A marriage that takes place in Germany will be registered in Germany.<\/p>\n\n\n\n

It will not be added to UK marriage records.<\/p>\n\n\n\n

You cannot obtain a German marriage certificate from a UK register office, British Embassy or British Consulate.<\/p>\n\n\n\n

The German authority or the person conducting the ceremony can explain how to obtain the German marriage certificate.<\/p>\n\n\n\n

You should keep the certificate safely. If you plan to use it outside Germany, you may need a translation or apostille depending on the destination country.<\/p>\n\n\n\n
