British Nationals Getting Married in Kenya<\/h2>\n\n\n\n

If you are a British national planning to get married in Kenya, you must follow the Kenyan marriage process.<\/p>\n\n\n\n

Your marriage will usually be recognised in the UK if:<\/p>\n\n\n\n

you follow the correct process under Kenyan law;
and the marriage would be allowed under UK law.<\/p>\n\n\n\n

The Kenyan registrar, local authority, religious official, venue or person conducting your ceremony can confirm which documents you need.<\/p>\n\n\n\n

The Kenya route is different from many non-Commonwealth countries. If a Kenyan authority asks for a Certificate of No Impediment<\/strong> or marital status affirmation<\/strong>, the key point is this: the British Embassy or British Consulate does not issue these documents for Kenya<\/strong>.<\/p>\n\n\n\n

You may need to explain this to the Kenyan authority and ask what alternative evidence they will accept.<\/p>\n\n\n\n

\n\n\n\n

No British Embassy Certificate of No Impediment for Kenya<\/h2>\n\n\n\n

For Kenya, the British Embassy or British Consulate does not issue a Certificate of No Impediment<\/strong>, also known as a CNI<\/strong>.<\/p>\n\n\n\n

It also does not issue a standard marital status affirmation<\/strong> for Kenya in the same way it does for some non-Commonwealth countries.<\/p>\n\n\n\n

If a Kenyan authority asks you for a CNI or marital status affirmation, you may need to explain that the British Embassy does not issue these documents for Commonwealth countries.<\/p>\n\n\n\n

You should check whether there is a standard letter or official explanation that can help confirm this position.<\/p>\n\n\n\n

This does not mean you have no documents to prepare. A Kenyan authority may still ask for other evidence, such as:<\/p>\n\n\n\n

a local notarised affirmation that you are free to marry;
a No Trace Letter from the UK General Register Office;
proof of identity;
proof of address;
proof that any previous marriage has ended;
or other documents required under Kenyan law.<\/p>\n\n\n\n

Before arranging your wedding, check the exact list with the Kenyan registrar, local authority or person conducting your ceremony.<\/p>\n\n\n\n

\n\n\n\n

Local Affirmation Before a Notary Public<\/h2>\n\n\n\n

Although the British Embassy does not issue a CNI for Kenya, you may be able to swear an affirmation that you are free to marry.<\/p>\n\n\n\n

You can usually do this before a local notary public.<\/p>\n\n\n\n

The Kenyan authority may ask for this type of declaration as part of the marriage paperwork.<\/p>\n\n\n\n

Before arranging the affirmation, check with the Kenyan registrar or the person conducting your ceremony.<\/p>\n\n\n\n

They can confirm:<\/p>\n\n\n\n

what wording they need;
whether the affirmation must be notarised;
whether it needs an apostille or further legalisation;
whether it needs to be recent;
whether supporting documents are required.<\/p>\n\n\n\n

This step is important because a notarial affirmation is not the same as a British Embassy CNI.<\/p>\n\n\n\n

\n\n\n\n

No Trace Letter From the General Register Office<\/h2>\n\n\n\n

You may also be able to apply for a No Trace Letter<\/strong> from the UK General Register Office.<\/p>\n\n\n\n

A No Trace Letter can show that no marriage record has been found for a person within the searched period.<\/p>\n\n\n\n

This may help where a Kenyan authority asks for evidence of single status or marital history.<\/p>\n\n\n\n

However, a No Trace Letter is not the same as a CNI.<\/p>\n\n\n\n

You should check whether the Kenyan authority will accept it before relying on it.<\/p>\n\n\n\n

\n\n\n\n

Marriage Registration in Kenya<\/h2>\n\n\n\n

If you marry in Kenya, your marriage will be registered in Kenya.<\/p>\n\n\n\n

It will not be added to UK marriage records.<\/p>\n\n\n\n

You cannot register the marriage later at a UK register office, British Embassy or British Consulate.<\/p>\n\n\n\n

You should keep your Kenyan marriage certificate as evidence of your marriage.<\/p>\n\n\n\n

If you want to use the certificate outside Kenya, you may need a translation, apostille or other legalisation depending on the destination country.<\/p>\n\n\n\n

\n\n\n\n

You Were Previously Married<\/h2>\n\n\n\n

If you were previously married, the Kenyan authority may ask for proof that the previous marriage has ended.<\/p>\n\n\n\n

For England and Wales, this usually means a:<\/p>\n\n\n\n

Decree Absolute<\/strong>;
or Final Order<\/strong>.<\/p>\n\n\n\n

A Decree Absolute<\/strong> is the older final divorce order. It usually applies to divorces completed before 6 April 2022.<\/p>\n\n\n\n

A Final Order<\/strong> is the current final divorce order. It usually applies to divorce cases issued on or after 6 April 2022.<\/p>\n\n\n\n

Both documents prove that the previous marriage has legally ended.<\/p>\n\n\n\n

The Kenyan authority may ask for the original, a certified copy, an apostille, a notarised copy or supporting evidence.<\/p>\n\n\n\n

Always check the exact requirement before submitting documents.<\/p>\n\n\n\n

\n\n\n\n

If You Do Not Have Your UK Divorce Document<\/h2>\n\n\n\n

Many British nationals no longer have a clear copy of their Decree Absolute or Final Order.<\/p>\n\n\n\n

Some only hold:<\/p>\n\n\n\n

an old scan;
a downloaded PDF;
a blurred photo;
a court email attachment;
an electronic divorce order;
or an unclear copy from an old file.<\/p>\n\n\n\n

This may cause problems if the Kenyan authority needs clear proof that your previous marriage has ended.<\/p>\n\n\n\n

You should check this with the Kenyan authority or the person conducting your ceremony.<\/p>\n\n\n\n

Some UK documents used overseas may need to be legalised with an apostille. Others may need notarisation, solicitor certification or local acceptance steps.<\/p>\n\n\n\n

For a UK divorce document, the common route may be:<\/p>\n\n\n\n
